At the evidence inspection on October 28, 2010 supervised by Lt. Sandra Brown, Lt. Sandra Brown stated that CPU server, HP serial number 2UB424055T, that taser videos are downloaded to and retained on was removed from property/evidence and placed into “traffic.”
Why would the Palo Alto Police place the CPU used for taser videos into use for another reason, a reason that would wipe out the evidence? Placing the CPU server into use in traffic was the Palo Alto Police’s way to eliminate any possibility of recovering the original taser videos by overwriting all of the video data on the hard drive. In fact at the March 31, 2009 Police Chief community outreach meeting, which Lt. Sandra Brown attended, the Palo Alto Police officers were instructing members of the public on the best way to erase the data from their computer hard drives which is by overwriting all of the data. |

The entire altercation began when Officer Kelly Burger stated that Ciampi was under arrest.
The dialog of Officer Burger stating, "You're under arrest," has been removed from Officer Burger's patrol car recording.
The reason is because he had no justification to make an arrest.

Officer Temores testiied during a court hearing under penalty of perjury that he did not record any audio onto his patrol car recording because the battery to the microphone had run out of power. The problem with that is Temores testified in a court hearing that the battery was charged when he went on duty and he did not use the battery at any time before the incident. A fully charged battery will run for 10 continuous hours. Temores should have recorded at least some audio given that he stated he turned the microphone on at the beginning of the incident.
Furthermore Santa Clara County Forensic Criminalist Christopher Corpora documented that Temores' MAV recording did pick up some audio, at low volume, but could not be made out due to this nature. If Temores' battery had not powered the microphone then there would be no audio; not even low volume audio. Temoes' battery did not run out of power as Temores testified; thus the audio has been deliberately tampered with, muted to not be heard.
Temores committed perjury in stating that his battery ran out of power and did not record audio onto his MAV recording.

Former Palo Alto Police Sergeant Natasha Powers is now a private investigator and police practices expert with her own consulting firm, Powers Police Practices Consulting & Investigations, in the state of Colorado. Powers is seen here being interviewed regarding a recent case in which Powers determined that a police officer should be terminated from his employment because he lied on a police report and muted his body cam audio.
Natasha Powers electronically muted/deleted Officer Temores' patrol car audio so that it could not be heard.
